I was  arrested  in Sinaloa  Mexico in 1993 for transporting  Marijuana.I was held  in the  Center  for  social readaptation for  a little  more  than a year  before  my case  was finally decided. I was  convicted  and  sentenced  to 10 years. and  a fine of  10,000  pesos. while  serving my sentence  I applied  for  tranfer  to the  United  States under  the  prisoner  exchange  treaty. After  nearly  3yrs  I was  accepted into the  program and  transferred to the  United  States.I was  moved  first to  another  prison in Monterey Mexico  with about  12 other  American Nationals  from different  prisons  in Mexico we were Held  there  for  several days  while  the  exchange  was  affected  we  met with a U S federal  Judge  and  a US public  Defender  that explained  the  process and  had  us  sign documents  agreeing to the  terms of  the  transfer.

We were  then transferred  to El Paso , TX airport  and  handed over to U S Federal Correction Officers and  transported  to La Tuna Federal  correctional facility in Anthony  New Mexico. I was  told  that I had  missed the  quarterly  Parole  board  hearing  and  would  have to wait  at least three months  for  the  next one. I was  interviewed  and  processed in to the  Prison and  began working  in the  kitchen there. My attorney continued  to review  my case  and discovered  that with  good  time I had  earned  in Mexico  working  as  medic  in the  clinic  and  my U S federal  good time I had  served  more  time  than required for  the  sentence  I had  been given under  the  U S resentencing Guidlines  and  I was  released.

 I was  sent back to Alaska where my Home is  and reported  as  ordered  to my Parole  Officer. I had  been given the  standard  3years  supervised  release. After  a short  time  in Alaska  I transferred  my parole  to Nevada and  finshed  my  three years  there  with no violations and  complied  with all conditions  of  my release. I was  given a letter  stating that I had  completed  the  sentence.

Since  that time  I have had  no violations  other  than one  speeding ticket which was  taken from my record  after  completing  and  paying for  8hrs  of  traffic school. My Question is  what are my chances  of  getting my record  Expunged.  I lost one  job when a background check came  back that I had  been convicted  of  smuggling  In Texas  and missed  another  job because  of  the  conviction  even though it  was ten yrs  since my conviction and release. I believe  my violation is  a 6th degree felony. I have  had to take  minimum wage  jobs  and  been restricted  from pursuing  several different  careers because  of it. My prior  record  consisted  of  two disorderly conduct misdeamors  about  7 yrs  apart. what are my chances  to get it  expunged  and  what would  it cost  I  am living now  on my social security  and  a V A disability  pension. In the terms  of  the transfer treaty  it states  that I would  lose  no civil rights  that I would  not have lost  had  I served  my entire  sentence  In Mexico.

Generally, the only court that can grant an expungement is the court that convicted the person.  I am not aware of any way for a US federal or state court to expunge a conviction in Mexico. 

I am actually very surprised that the foreign conviction is appearing on any background check.

It appears  because I transferred  to a US Prison and was  resentenced  under  U S federal guidlines.It dooesn't  show on my record  as  A mexican crime  but as  an American  one  though I never  committed  any federal crime In the United  States

I never  appeared in  any court in the United  States. So where  could  I go to seek an expungement. No one  seems to be  able  to help me  with  this. Served  the  time  and  probabtion paid  the  fine  lfollowwed  all conditions of  rease. So who  do I talk to for  help.

I think the only court that can expunge the conviction would be the court in Mexico. Then, you would have to hope that the US agencies would respect the foreign country's request to expunge the record.  My guess would be to start with an attorney in Mexico.
