	<description><![CDATA[<p>California’s expungement law permits someone convicted of a crime to petition the court to re-open the case, set aside the plea, and dismiss the case. So while the case is not completely removed or destroyed, it is no longer considered a conviction.</p>
<p>Whether the case will appear depends on the type of background check that is used.  If the employer does your standard commercial background check, the chances are the case will not appear at all.  If the employer requires you to submit fingerprints and provide a copy of your CA Dept of Justice report, it will show that there was a case, but it was dismissed and there is no conviction or finding of guilt.  You can truthfully say you were not convicted to any question for employment.  The only time you have to disclose the conviction is in three narrow circumstances. (1) If contracting with the CA State Lottery Commission.  (2) When applying for public office (mayor, congressman, etc.) (3) When applying for a state license.  When applying for a state license, you would need to disclose that you had a conviction that was later dismissed.  This is a big improvement over simply saying you have a conviction.</p>

	<description><![CDATA[<p>Hi I am 38 and was convicted in 2005 for possesion and attempted sales of marajuana. I compleated my probation and paid my fines and have completly changed my life. I have an attorney working my case for me at no cost because I am a full time student to be a medical assistant here in Arizona. My husband makes 7.25 an hour and have a 3 year old little boy. Any ways this attorney can expunge my record or I should say part of it. What I want to know is what part gets expunged and what does not. I have worked so had for my career I have a 3.77 GPA Secretary of Student Activities Council, President of our Phi Theta Kappa Chapter, have certificates from the Dean and Hornor Society, as well as letters from Proffesers stating my credibility. I pled guilty to a H&#38;S 11359. Can you explain what will get expunged and what will not and If I am wasting my time with this career even though this is my last year.</p>

	<description><![CDATA[<p>I am a resident of Broken Arrow, OK. and am trying to get my conceal carry license but I have on my record in Dallas, TX an arrest and conviction of posession of a controlled substance.&#160; This arrest and conviction was June 30, 1977.&#160; I was fined $150. but it is blocking my CCW.&#160; I appealed OK judgement and was denied.&#160; The OSBI suggested to hire a lawyer in Dallas to see if it could be expunged.&#160; Is it possible and who would you suggest.<br />
I was 19 years old.&#160; Am now 55yrs old and in the Ministry.</p>

A year later i try to join the Marines everything was going fine i told them about the incident and they said that there was no problem because i wasn&#039;t convicted, a couple of days later the recruiter call me and said that even though i wasn&#039;t convicted the arrest appear on some federal information . 	<description><![CDATA[<p>If you were convicted of a M3 in PA, besides appealing the conviction, your other option is to seek a pardon from the Governor of Pennsylvania.  Misdemeanor convictions are not currently eligible to be expunged; however, there is currently a bill pending in the PA Senate that would change the expungement law and make certain M3 convictions eligible after 7 years free from arrest.  </p>

<p>I am applying to take the bar, and I need to state whether I have "ever been charged with or been the subject of any investigation for a felony or misdemeanor other than a minor traffic charge."</p>
<p>A few years ago I was given a citation for being on a beach after it had closed in Wildwood, NJ. I am from out of state and was unaware that the beach had closed. I paid the ~$80.00 fine. </p>
<p>Is this a misdemeanor in NJ, and do I need to report it on my bar application?</p>
