Is there any way to get traffic violations removed from a driving record? My boyfriend is about to lose his job due to too many violations. At least one of the tickets was bogus, but it was easier to pay the fine than to contest it.

I've found information about how to prevent it from going on the record in the first place, but nothing about erasing it after the fact.

I have a felony from 2005 that has been expunged for several years. I currently have a pardon application pending. I have read everything that I can find regarding Arkansas Act 1491 which changed A.C.A 5-73-103 and am under the influence that currently an expungement will give you the right to bear arms back. My only question is if Act 1491 is retroactive. Does anyone know of an opinion on this matter? Thanks for the help

Most traffic tickets are not criminal offense that can be expunged. However, the following traffic offenses are expungeable as misdemeanors:

(a) The following traffic law violations shall be known as offenses and classified as indicated:
(1) Racing on a public highway -- Class A misdemeanor;
(2) Reckless driving -- Class B misdemeanor;
(3) Driving with lights off to avoid detection, identification, or apprehension -- Class B misdemeanor;
(4) Hazardous driving -- Class C misdemeanor;
(5) Leaving the scene of an accident involving property damage only -- Class C misdemeanor;
(6) Driving the wrong way on a one-way street -- Class C misdemeanor;
(7) Speeding in excess of fifteen miles per hour (15 m.p.h.) over the posted speed limit -- Class C misdemeanor;
(8) Using nitrous oxide in a motor vehicle or motorcycle on a street or highway as prohibited under Sec. 27-37-803 -- Class C misdemeanor; and
(9) Observing a drag race as a spectator on a public highway -- Class B misdemeanor.
(b) More than three (3) violations in a twelve-month period -- Class C misdemeanor.

A citation for careless and prohibited driving is not included in this list; but, if you see your offense listed above then you can apply to have it expunged under Act 531.

The costs associated with expunging a record will only be attorneys fees if you choose to hire an attorney. Attorney's fees usually range from $500 on up. There are no filing fees with the court, so if you file the petition yourself, there will be no costs.

Whether your record can be expunged depends upon what you were convicted for. You can visit my website and go through the flowchart to get an idea as to whether you are eligible to have your record expunged. (http://rosalynwatts.com).

If you get your record expunged you will then need to apply for a partial pardon through the governor's office to have your firearm rights restored.

You do not have to live in Arkansas to apply to have your record expunged; however, if the prosecutor objects to your petition to seal you will have to attend a hearing to determine if your record will be expunged.

Hi,

I was charged with 2 felony convictions 3 years ago, I paid for my charges and went on probation (both supervised and unsupervised). Since now it has all ended, I want to expunge the records so I can get a job. How can I remove the records? Can I get my gun rights back? Can I expunge it even if I don't live in Arkansas anymore?

Thanks.

I am not aware of any way to delete information from search engine— or more importantly, delete information from most web sites. Unless the web site falls under specific regulatory restrictions, like credit report agencies do with the Fair Credit Reporting Act, most web sites will have First Amendment Protection when they publish news (even old news) or things that still remain in the public record. Some people employ the services of online reputation management companies to help make sure specific web sites to not appear in the first few pages of the search engines. I can refer one or two of such companies if you like.

Is there a way to delete criminal information, (51 years ago), from search engines? This was a murder charge when I was 14 years old. I was released after six years, entering college on that day and graduated four years later with honors. Many achievements in college, including president of senior class. Attended law school for one year and then in business for 35 years. Adopted a baby, who is now a practiicing attorney. However, anyone can google my name and find out about my past. It would destroy my daughter if she researched my name and found this information.

Based on the information you have provided, it appears that you are eligible to have your record expunged.

In order to get your record expunged you will need to complete a petition to seal and file it with the clerk's office where you were convicted. You can get a copy of a petition to seal at http://www.acic.org.

After your record is expunged you will need to get a partial pardon through the governor's office to have your firearm rights restored.

The law regarding the restoration of firearm rights after expungement in Arkansas changed effective March 13, 1995. If you were sentenced prior to that date, you need only have your record expunged to have your firearm rights restored. However, beginning on March 13, 1995, you will have to take the additional step of getting a partial pardon through the governor's office to have your firearm rights restored.

If you were only charged with sexual assault and not convicted, your record is eligible to be expunged.

However, if you were convicted and your conviction was in Arkansas the answer to your question depends on whether you have a felony conviction or a misdemeanor conviction.

If you were convicted of a felony sexual assault, your record cannot be expunged. However, you can attempt to have your conviction pardoned in 2012. (You have to wait 8 years after your conviction to apply for a pardon).

If you were convicted of a misdemeanor sexual assault, if you were required to register as a sex offender you cannot get an expungement. However, if you have a misdemeanor conviction and were not required to register as a sex offender, you are eligible to have your record expunged.

Hope that helps.
