Mr. Higbee, unfortunately today is Sept. 13 and I just now saw the notice for the workshop. I am very much interested in expunging my record and would like to know will there be another workshop or is there other avenues I might pursue. My funds are very limited so I am more interested in something I might accomplish myself or at little expense.

I believe Long Beach does an expungement workshop about twice a year. I will post news on any free workshop or expungement related program that we discover. My law firm is planning to sponsor one in December, but details have not been finalized. They will be posted here once they are finalized.

Is it possible to request the a case be destroyed in California (finding of factual innocence – Penal Code 851.8) if the case was expunged per 1204.3?

    • Mathew Higbee, Esq says:

Yes, it is possible, insofar as judges can and have granted relief pursuant to Penal Code 851.8 on a case that was dismissed pursuant to Penal Code 1203.4 (expungement). However, it pretty much requires a judge to step outside the bounds of the law and it rarely ever happens. My law firm does not ever take such cases… and strategically, it may be the rare type of case that a person is better off representing themselves.

Please let me know when your next no cost expungement work shop will be held.

    Thanks

My law firm will be hosting an expungement seminar for people who meet the state’s low-income requirements in December. Date and location to be determined. Please keep checking back for updates.

December expungement seminar has date and location been determined.

    Thank You

Do you have to be a resident of Long Beach to attend this seminar?

    • Mathew Higbee, Esq says:

No. However, at this point, you will need a time-machine to attend. We will post news about any upcoming ones that we learn of.

  6. Bob Kittel says:

Will a workshop help with arrest records when there was not a court filing? Arrest records are visible and can make it so a person can not be considred for a job. If a case was filed but dropped by the court does this record need to be sealed or can it?

    • Mathew Higbee, Esq says:

Yes, arrest records in California can be sealed if they did not lead to a conviction and if you can prove you were factually innocent. See CA Penal Code section 851.8.

We currently do not have any workshops scheduled. We will update the website with any we schedule in the future. However, you would receive assistance at the workshop with completing the required forms, but you would still need to file them yourself.

Unfortunately we do not have any workshops scheduled at this time. If you have specific questions on a portion of the petition, please let us know and we can try to assist. Otherwise, you may want to try contacting your local public defender’s office to see if they can offer any assistance to ensure you have it filled out properly.
