Expungement of Utah Criminal Convictions » Requirements
To be eligible to have a conviction expunged, you cannot have:
- Two or more felony convictions, each of which is contained in a separate criminal episode.
- Any combination of three or more convictions that include two class A misdemeanors, each of which is contained in a separate criminal episode.
- Any combination of four convictions that include three class B misdemeanors, each of which is contained in a separate criminal episode.
- Any combination of five or more convictions of any degree, each of which is contained in a separate criminal episode.
Please keep in mind, that in most cases, you can also try to file a motion to reduce the level of offense and thereby make you eligibile if you do not meet the criteria above. If you cannot reduce it to make yourself eligible, you can apply for a pardon from the governor.
And you must paid all fines and restitutions ordered by the court. You must also meet waiting periods listed below. The waiting periods start from the time you FINISH your sentence. In most cases, you can also file a motion to reduce the level of offense and thereby reduce the waiting period.
From the time the sentence (including probation and parole) is complete
- Capital felony; Felony 1; Forcible felony 2;any sexual offense against a minor Never
- 2nd and 3rd degree felonies 7 Years
- Class A misdemeanor 5 years
- Class B misdemeanor 4 years
- Class C misdemeanor 3 years
- Alcohol related traffic offenses (Title 41) 10 Years
