With two exceptions, only non-conviction data can be expunged. In order to be considered non-conviction data, it must fit the following requirements:

  • There is no pending action on the conviction at the time.
  • Your arrest record has no disposition, and took place after eighteen (18) months.
  • Your case was dismissed or discharged because of lack of evidence, or because there was no finding of guilt after trial.

If your record is successfully sealed, the expunged record will not appear on background checks. However, the District Attorney and Central Repository may maintain a list of the names and criminal history of individuals who successfully completed the conditions of any pretrial or post-trial diversion or probation program.
