Dejesus

I was convicted March of 2009 for a Class B Misdemeanor (Theft by deception) I was put on probation for one year. When would I be eligible to do an expungement? And is there a way I could get the conviction reduced? Finally any idea of cost?

Mathew Higbee, Esq

Yes, you can get a reduction to a class C misdemeanor.  Such a reduction would shave a year off of the waiting period (reducing it from 4 to 3 years from the time you complete your sentence).

My law firm charges $900 to do a reduction.   If you meet low income requirements, Utah Legal Aid may be able to help you for free or a reduced cost.

You can read the law at Utah Penal Code Section 76-3-402(2)
