I am trying to get a felony expunged. Â I received a gubernatorial pardon in 2010 for a crime I committed in 1981. Â From what I understand, a gubernatorial pardon (a) does not remove the records from the county courthouse, so I am still obligated to answer 'yes' to the '…ever been convicted of a felony' question and (b) A gubernatorial pardon entitles recipient to judicial expungement, after which an offender may deny that he has been convicted. Â Commonwealth v. C.S., Â 534 A2.d 1053 (Pa. 1987). Â I have not been in trouble since and would like to re-enter the workforce in the insurance industry (where I worked for many years).
My conviction was in Mercer County and I am having great trouble filing there. Â They keep telling me that I must have an attorney (a violation of my civil rights). Â All I need is a link to the form for the petition that the county clerk will accept. Â None of my research indicates a specific form for a petition to follow a pardon. Â Will a petition from the law library be sufficient? Must I have an attorney? I called the bar association who referred me to two attorneys, one of whom said I could not expunge this record. Â Who is right? How can I move forward with this and my life? Â
