Unfortunately, your felony would not be eligible to be expunged for
8 or more years. While New Jersey does allow for the expungement of
felonies, there are a few requirements that must be met. One requirement is
that a full 10 years must have passed since the completion of probation,
incarceration and payment of fines (whichever is latest). You also would not be
eligible if you have any pending charges against you, or have been convicted of
another crime in New Jersey or any other state. Additionally, certain types of
crimes may not be expunged (generally these include sex crimes, murder,
manslaughter, arson, crimes against children, robbery, sale of hard drugs,
DUI's and other motor vehicle offenses, and other crimes). You would also be
ineligible to have your felony expunged if you have ever had a criminal
offense expunged in New Jersey or another state, have received  3 or
more disorderly or petty disorderly violations against you or if you
have ever been granted dismissal of charges through pre-trial intervention
(does not include disorderly or petty disorderly offenses).
