Hi there,

I am currently a junior in college, and I did something really stupid the other day, and got arrested. The police let me go, but I am really worried about the arrest, because im in college on scholarship, and I have to submit for renewal yearly, so I do not want to lose my college money because of something stupid (in case they check my background, i guess). Would this be a good situation to get an expungement?

Hi Michelle,

If your college is actively searching arrest/conviction records (and many of them do for scholarship purposes), you should seriously consider having the arrest expunged from your record. Simply, the small amount of money spent to have your record wiped clean pales in comparison to the potential of losing thousands of dollars in scholarship money.

Fortunately for you, NH law is very clear on your rights here. According to section 651 of the NH criminal code, "Any person whose arrest has resulted in a finding of not guilty, or whose case was dismissed or not prosecuted, may petition for annulment of the arrest record at any time".

That's right. You should get the matter handled ASAP. This shouldn't be a big problem.
