Yes, driving while intoxicated is eligible for expungement in Minnesota. Many judges are reluctant to grant an expungement of DWI offenses… make sure you present the strongest case possible.

Dear Mathew,

I found out this website( http://www.mndefenselawyer.com/record-expungement.html ) and it says that-

"Records of serious crimes like murder and sex offender crimes are never
expunged. Similarly, enhanceable offenses, like DWI, are not expunged.
Less serious crimes may be expunged only if we can convince the judge
that the benefits of expungement to you outweigh the disadvantages to
the public. It is important to note that even when the court grants an
expungement of a conviction, the records kept by some agencies,
including the BCA, might not be sealed."

Can you please clarify this?

I have seen that too.  In fact, I have heard it from several court clerks.  However, I can find nothing in the law that prevents a DWI from being eligible.  Furthermore, we have expunged a DWI for a client.  That being said, they are difficult.  We have lost more DWI cases in Minnesota than we have won.
