My son was arrested 10 yrs. ago for grand theft (3rd degree). Prosecution was deferred for a period of 18 mos. so he could enter the Pre-Trial Intervention Program. He was recommended for termination from the program on full compliance to the PTI agreement. Charges were dismissed against him before a trial and made effective 3 years later. So he didn't have to go to trial. This has been his one and only offense.
Now, 10 yrs. later, he is married and has a baby due any day. He cannot find any kind of employment even though he has better himself educationally and is a good worker. He has been making the rounds to secure employment and, at first, the potential employers are impressed with his resume and various certificates of programs he has completed. But once they check his background records, they are no longer interested. It doesn't help that he explains that this was his only brush with the law. I think that is so unfair. Can his record be expunge from this one offense so he can start living again?
