Hey there,

My (now adult) nephew and a couple of friends got arrested a few years ago for vandalizing a few buildings (mostly just spray painting). They were arrested and charged a fine, which they paid. According to this website, since we live in Nevada, he's eligible to get his record sealed (he recently turned 21, and he was 16 when he committed the crime).

There's a slight issue though — when I took a look at his record, it noted that his arrest and conviction was considered a federal offense. I guess one of the buildings he vandalized was a Post Office, which counts as a federal offense. Does that mean he isn't going to be able to seal his record after all, because it was a federal offense?

If the conviction occurred in federal court, it will be federal law that dictates what can be done. Unfortunately, at this time there is no federal expungement or record sealing law for convictions (except for a couple of low level drug offenses). Nevada's outstanding record sealing law only covers offenses tried in Nevada state courts.
