I was convicted of Marajuana possesion for sale HS11359 way back in 1989. In 2006 I filed 1203.4 dismissal after conviction (which was granted) however I also filed PC17 which was denied…court said something about it (the conviction) being to old & the evidence no longer exists. I am wondering if I can file the 17pc again, I have the arrest report to provid the evidence that it was just marajuana possesion greater than an ounce.

And if I can file for the pc17 & it gets granted will I be able to get my firearms rights back?

I am not sure what the court was talking about, but violations of Health and Safety Code 11359 are not reducible.  Sorry for the bad news.

 

11359 "Every person who possesses for sale any marijuana, except as otherwise provided by law, shall be punished by imprisonment in the state prison."
